Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

Usage

Promotion Hosting will strive to keep its services running reliably but Promotion Hosting will not be held responsible for any losses you may incur through their use. If you are a business, you should ensure that you have adequate business insurance, and we recommend you contact an insurance agent or broker. As a customer of Promotion Hosting, you agree to indemnify, defend and hold harmless Promotion Hosting, its officers, directors, employees, affiliates, or resellers from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) that may arise from your use of our services. Unless specifically addressed and mutually agreed to within a service level agreement or security plan, Promotion Hosting will not cover you for any losses due to hacker attacks, denial of service attacks or other criminal activities. If your business relies on your Web site for commercial purposes, it is your responsibility to ensure that you have proper business insurance coverage. As a customer of Promotion Hosting, you agree that you are responsible for any content you provide via your Web site, and it is your sole responsibility to ensure that it does not infringe upon any existing trademark or copyrighted material.

Content

All services provided by us may only be used for lawful purposes only. This includes, but not limited to copyrighted material, material we judge to be threatening or obscene, child pornography, etc.

Promotion Hosting reserves the right to refuse its service to anyone we think in our judgement is hosting obscene, threatening, or illegal material. Such accounts will be removed from our services with or without notice.

E-mail Policy

- Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice. You are not allowed to mail to a mailing list you were given or purchased. This is spamming because they never agreed to you personally sending them mail. As far as we are concerned there is no justification for this as it is spam in our book and will result in the termination of the offending account.

We reserve the right to apply changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at our sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion. We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Promotion Hosting. - E-mail Limits and Mailing List Rules
As we offer your hosting accounts in a shared hosting environment, you are permitted to send a maximum of 200 E-mails an hour per domain beyond which all mail sent will bounce back with an undelivarable error during that hour. Our server has been set for you to check your POP mail at a maximum of 60 checks per hour per E-mail address. We strongly advise you to set your E-mail client to check your mail to 10 minutes or higher.

If you are using a mailing list you are required to throttle your program to send one mail every six seconds. Anyone who causes the servers load to go high will be suspended and the process will be terminated. If you choose not to throttle you will most likely be suspended for crashing the server. PHPlist can throttle your mail for you and is offered with Fantastico in your cPanel. Any mailing list larger than 4000 is not permitted. Any mailing list over 900 emails is only allowed to be sent during off-peak times to prevent high server loads. Off peak times qualify as all day Saturday and Sunday, and 1am - 8 am eastern time M-F.

Payment Information

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify PromotionHosting.com of your desire to cancel any or all services received, those services will be billed on a recurring basis. In the event of a chargeback being submitted by a customer against their payment for our services, we reserve the right to disable an account with immediate effect.

Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

Cancellation and Refunds

We reserve the right to cancel an account at any time. We give you an unconditional 30 day money back guarantee on your managed shared hosting provided you have met with our terms of service during your account being hosted by us. To cancel a hosting account, the client is required to issue this request from their client area.

Only first-time accounts are eligible for a refund. For example, if you''ve had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Resource Usage

Users may not initiate the following:

a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Money back Guarantee

We give you an unconditional 30 day money back guarantee on your managed shared hosting provided you have met with our terms of service during your account being hosted by us. Beyond the 30 day period, we reserve the right to refund a prorated amount or no refund at all depending on the circumstances, at our discretion.

Price Change

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on our site, and the right to increase the amount of resources given to plans at any time.

Indemnification

The Customer agrees that it shall defend, indemnify, save and hold Promotion Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of:

a) any injury to person or property caused by any products sold or otherwise distributed in connection with us.
b) any material supplied by a customer infringing or allegedly infringing on the proprietary rights of a third party.
c) copyright infringement.
d) any defective products sold to customers from the Promotion Hosting servers.

Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.
